ANÁLISE DA PERSPECTIVA JURÍDICA SOBRE O CRÉDITO DE FLORESTA

This paper concerns Forest Credit, through bibliographic methodology based on the analysis of national and state legal references using the comparative method of the Decrees of the States of Goiás, São Paulo and Santa Catarina. Forest credits have the legal nature of a title of right over an intangible and intangible tradable asset, being classified as one of the forms of payment for environmental services. Forest credits are financial instruments that aim to encourage the conservation and sustainable use of forests. Thus, they can be used as payment for ecological services because they are the maintenance of the natural environment and not for the payment of environmental services because these are performed by human action. The legal nature of forest credit is similar to Carbon Credits (Certified Emission Reductions), since both are types of Clean Development Mechanisms (CDM) and are classified as intangible, intangible and tradable assets. In this context, it is suggested to change the term payment for environmental service to compensation for environmental services. In this particular case, the State of Goiás, through its parks and other ecological reserves, can act as a provider, thus benefiting from considerable monetary sums. Finally, the State of Goiás is a pioneer in the presentation of Forest Credits that do not establish any type of preference in relation to Brazilian biomes, conserving all and any type of forest and not only the Amazon Rainforest, but also other Environmental Service Payments.
